Psilocybin mushrooms were never listed in Jamaica's Dangerous Drugs Act, and in 2021 the Agriculture Minister said it is legal to grow them. There is no licensing regime for retreats, and in August 2024 the Ministry of Health said it has not approved any psilocybin product. The position is unscheduled and unregulated, not licensed, and the head of the National Council on Drug Abuse has asked for the Act to be amended.

On 18 July 2021 the Jamaica Information Service quoted Agriculture Minister Floyd Green: "In Jamaica, the reality is that we never promulgated any laws to make psilocybin illegal here and as such, it is legal now to grow psilocybin."
