Illegal but tolerated in practice: possession for personal use is an administrative offence, but supplying psilocybin is trafficking. Retreats advertise openly and we found no reported prosecution of one.

Psilocybin is on Table II-A of Decree-Law 15/93. Since Law 30/2000, possession for personal use is an administrative offence rather than a crime, but the Policia Judiciaria states that producing, selling or transferring the mushrooms is drug trafficking, which is what a retreat supplying them does. Retreats nonetheless advertise openly, and a news search in English and Portuguese on 4 October 2026 found no reported prosecution of a psilocybin retreat or facilitator; the closest cases involve festival sellers and a home grower. That can change without notice, and participants and operators carry real legal risk.

No reported prosecution, raid, arrest or closure of a psilocybin retreat or psilocybin facilitator in Portugal was found. The closest items concern festival drug sellers, a home grower, and an ayahuasca/DMT production case. The absence of reported cases is not proof that none occurred, and enforcement practice can change without notice.     An analysis of online reports found that 47% of 62 reports of lithium taken with a classic psychedelic (such as psilocybin or LSD) involved seizures and 39% involved medical attention, while none of 34 lamotrigine reports did. The authors provisionally concluded psychedelic use may pose a significant seizure risk for people on lithium. (Pharmacopsychiatry, 2021)

    Published research safety guidelines recommend excluding volunteers with a personal or family history of psychotic disorders or other severe psychiatric disorders, and note prolonged psychoses triggered by hallucinogens are less common than acute distress. Oregon's Client Information Form bars anyone who has ever been diagnosed with or treated for active psychosis.
