The legal position in Jamaica

Psilocybin mushrooms were never listed in Jamaica's Dangerous Drugs Act, and in 2021 the Agriculture Minister said it is legal to grow them. There is no licensing regime for retreats, and in August 2024 the Ministry of Health said it has not approved any psilocybin product. The position is unscheduled and unregulated, not licensed, and the head of the National Council on Drug Abuse has asked for the Act to be amended.

On 18 July 2021 the Jamaica Information Service quoted Agriculture Minister Floyd Green: "In Jamaica, the reality is that we never promulgated any laws to make psilocybin illegal here and as such, it is legal now to grow psilocybin." He said interim protocols route participants through the Plant Quarantine Division. (Jamaica Information Service, 18 Jul 2021; Ministry of Agriculture, Fisheries and Mining (Jamaica), 2021)
In a statement of 23 August 2024, the Ministry of Health and Wellness said it has not approved psilocybin mushroom-containing products for use on the Jamaican market, and warned that they can be dangerous to health. (Jamaica Gleaner, 24 Aug 2024)
In February 2024 the head of the National Council on Drug Abuse called for the Dangerous Drugs Act to be amended to cover magic mushrooms, which confirms they are not currently listed. (Jamaica Gleaner, 15 Feb 2024)
A 2025 University of Miami law review article says psilocybin was never listed under Jamaica's Dangerous Drugs Act and remains unregulated. (University of Miami Inter-American Law Review, 2025)
